The duties of the position include, but are not limited to:
- Performing Continuum market analysis activities and market conduct Continuum actions or examinations of insurers, HMOs, HCSCs, Carriers, HCBMs, and other regulated entities doing business in Washington state.
- Verifies that licensed insurers and other entities are operating within the scope of their license and in compliance with Washington state statutes and regulations relating to conduct in the marketplace.
- Assessing how well individual insurance companies and other licensed entities that make up the insurance marketplace comply with state and federal regulations.
- Reviewing and analyzing company policies and procedures, records, and files, such as:
Tasks include:- Using the NAIC Market Regulation Handbook for guidance and as a resource to conduct Continuum actions and examinations on regulated entities to assess compliance with the laws and rules outlined in Title 48 RCW and Title 284 WAC and recommend corrective or enforcement actions for entities found to be non-compliant.
- Reading and interpreting applicable laws, regulations, and standards to include, but not limited to Title 48 RCW, Title 284 WAC, NAIC Market Regulation Handbook, and other procedural manuals.
- Requesting and compiling, data and information from resources such as database queries, financial documents, past reviews, other states, and directly from regulated entities needed to research and analyze a variety of regulated areas, including internal processes, standards, claims handling, underwriting practices, sales and marketing strategies, and numerous other market-related practices to ensure entities are compliant and consumers are protected.
- Documenting thoroughly and promptly all actions taken, correspondences, research and reference materials, and any other relevant information gathered during a continuum action or examination that support the analysis and review of the entity or entities involved to substantiate findings, conclusions, and any recommended enforcement actions.
- Working diligently to complete assigned cases within estimated timelines and achieve outlined objectives/ goals within statutory requirements.
- Building collaborative and positive relationships with OIC personnel at all levels and other state regulators to gather information, work with subject matter experts, develop investigative strategies, provide progress updates, interpret findings, and formulate conclusions.
- Building professional relationships with key contacts at the entity(s) being reviewed and using clear, concise verbal and written communications to articulate requests to coordinate information gathering, review and discuss relevant laws, and explain the findings and outcomes of the Continuum or exam.
- Reviewing and interpreting responses from entities to confirm they are complete and address the specific issue(s) in question, identify potential additional issue(s), and complete subsequent follow-up information requests as needed to ensure the issue(s) is thoroughly investigated and well documented.
- Reporting to the CMCE and Lead Examiner on a routine basis, the status of any open Continuums or exams, and ensure documents used to track status are current, note any findings, communicate past and future activities, and capture recommendations.
- Writing a summary document at the end of a Continuum or examination, detailing the examiner's activities, a recap of findings, an evaluation of compliance with Washington laws and regulations, and suggested next steps.
- Preparing enforcement referrals for the Legal Affairs Division, when necessary, that summarize the company's actions and the activities undertaken by the examiner to identify and verify the violations, the number of potential violations, the potential impacts on consumers, and the basis for citing the violations to include the relevant laws and regulations.
- Ensures TeamMate is clear, verified, and complete before closing a market action.
Daily examiner activities as well as encouraged activities can include:- Communicating with co-workers, to provide or obtain information and feedback regarding analysis procedures, market issues, or work products.
- Participating in assigned NAIC, IRES, Industry, and Agency training sessions to gain knowledge and skills requisite to the performance of Market Conduct Actions.
- Enhancing knowledge and skills requisite to the performance of Market Conduct Continuum Actions and activities through offered industry courses, webinars, and company or OIC conducted training courses.
- Completing various administrative forms such as leave requests, travel requests, travel expense reports, training requests, and other forms per departmental policy accurately and in a timely fashion.
- Using various office technologies and software (e.g. laptop, printers, copy, scanners,) to facilitate research and analysis-examination efforts and to conduct administrative tasks.

Required Qualifications:
The incumbent must meet one of the minimum required qualification options listed and any additional qualifications included in the required qualifications section.- Option 1: Six (6) years of working experience, in the professional private or public sector, on one or more lines of insurance, health care service contractors, or health maintenance organizations OR professional private or public work completing detailed audits or analysis to ensure compliance with governmental statutory and regulatory requirements.
- Option 2: Associate degree in business administration, insurance, economics, finance, or related field AND four (4) years of working experience, in the professional private or public sector, on one or more lines of insurance, health care service contractors, or health maintenance organizations OR professional private or public work completing detailed audits or analysis to ensure compliance with governmental statutory and regulatory requirements.
