This hybrid position can be based out of Washington DC or Philadelphia, PA.
SUMMARY OF DUTIES:
Amtrak seeks a construction, public procurement, and government contracts lawyer, with an emphasis on drafting and negotiating construction agreements (including alternative deliveries, such as progressive design build, delivery partner, and construction manager at risk), and working through the entire life cycle of large-scale procurements (RFI, RFQ, RFP, bidder questions, award, and through NTP). This attorney would provide legal support on commercial construction contracts, project controls, project risk and quality for all program/project delivery teams and for generally ensuring legal support for safe, on-time, on-budget delivery of high-quality assets. The successful candidate must become fully knowledgeable about applicable federal and state statutory and regulatory requirements, Amtrak’s capabilities and constraints, Amtrak’s grant agreements, and the needs, obligations, and constraints of Amtrak’s stakeholders including state and commuter partners. After an agreement is executed, the lawyer will provide legal services in the on-going administration of that agreement, including potential construction litigation, advice and counseling, forensic accounting and construction scheduling, award determinations, protests, contract administration, and claims resolution, which can stretch over several years.
ESSENTIAL FUNCTIONS:

Provide legal counsel and guidance on complex construction projects and alternative delivery methods such as: A/E (architect/engineering), CM/PM (construction manager/project management), CMAR (construction manager at risk), PDB (progressive design build), DP (delivery partner), and design-build, design-bid-build.
MINIMUM QUALIFICATIONS:

Juris Doctor from accredited law school and admission to and current good standing in a state or the District of Columbia bar.

Knowledge and experience in governmental contracting at the state or federal level.

Demonstrated experience developing, implementing, and administering internal corporate programs.

Ability to communicate orally and in writing to people at all levels within and outside of the organization on potentially sensitive or highly charged issues sufficient to exchange information, work cooperatively, facilitate understanding, and persuade and influence others.

Ability to use common office software for developing and exchanging electronic correspondence (e.g., Microsoft Outlook, Microsoft Word, Microsoft Excel, Microsoft PowerPoint, Microsoft Teams, Zoom, OneDrive).
PREFERRED QUALIFICATIONS:

A general understanding of and experience with construction law, government contracts, large-scale public procurement, environmental law, utilities law, and real estate law.

At least nine (9) years of professional legal experience providing legal advice and guidance on construction matters in a corporate, governmental, or law firm environment.

The salary/hourly range is $163,000-$211,140, Pay is based on several factors including but not limited to education, work experience, certifications, internal equity, etc. Depending on an employee’s assigned worksite or location, Amtrak may consider a geo-pay differential to be applied to the employee’s base salary. Amtrak may offer additional incentive and pay programs to recognize and reward our employees, including a short-term incentive bonus based upon factors such as individual and company performance that is commensurate with the level of the position and/or long-term incentive plan compensation.
